Please read these terms carefully before using the Truering website or services.

These Terms & Conditions ( "Terms") govern your access to and use of the Truering website, software-as-a-service platform, and related services (collectively, the "Services") provided by Brighto Credit Information Pvt. Ltd. ("Brighto", "we", "us", or "our"), a company incorporated in India.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use our Services.

1. Definitions

  • "Account" means the registered account created by you or on your behalf to access the Services.
  • "Customer Data" means all data, recordings, leads, contacts, and content submitted by you or your users through the Services.
  • "User" means any individual authorized by you to use the Services under your Account.
  • "Subscription" means the paid or trial access plan selected by you for use of the Services.

2. Use of the Website

You may use our website for lawful purposes only. You agree not to use the website in any way that could damage, disable, overburden, or impair our servers or networks, or interfere with any other party's use of the website.

3. SaaS Subscription and Account

  • To access certain features, you must create an Account and provide accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account.
  • We reserve the right to suspend or terminate Accounts that violate these Terms or remain inactive for an extended period.
  • Subscription terms, including pricing, billing frequency, and included features, are described on our pricing page or in a signed agreement.

4. User Responsibilities

When using Truering, you agree that you and your Users will:

  • Use the Services in compliance with all applicable laws, including telecom regulations, data protection laws, and anti-spam rules.
  • Obtain all necessary consents before making outbound calls, sending messages, or processing personal data through the platform.
  • Not use Truering for fraudulent, abusive, harassing, defamatory, or unlawful activities.
  • Not attempt to reverse engineer, copy, modify, or create derivative works of our software.
  • Maintain the accuracy and lawfulness of all Customer Data uploaded to the platform.

5. Intellectual Property

All content, trademarks, logos, software, designs, and materials available on or through the Services are the property of Brighto or its licensors and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services in accordance with these Terms. No ownership rights are transferred to you.

6. Payment and Billing

  • Subscription fees are charged in accordance with the plan selected and any applicable agreement.
  • Payments are non-refundable unless otherwise stated in a specific agreement or required by law.
  • We may change pricing by providing prior notice. Continued use after the change constitutes acceptance.
  • You are responsible for all applicable taxes, duties, and government charges.

7. Data Processing and Security

We implement reasonable security measures to protect Customer Data. Our processing of personal data is described in our Privacy Policy and any Data Processing Addendum executed between the parties. You retain ownership of your Customer Data.

8. Limitation of Liability

To the fullest extent permitted by law, Brighto shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Services.

Our total liability for any claim arising from or relating to these Terms or the Services shall not exceed the total amount paid by you to us in the twelve (12) months preceding the event giving rise to liability.

9. Indemnification

You agree to indemnify and hold harmless Brighto, its directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of your use of the Services, your Customer Data, or your violation of these Terms.

10. Termination

Either party may terminate a Subscription in accordance with the termination provisions in the applicable agreement. We may suspend or terminate your access immediately if you breach these Terms. Upon termination, your right to use the Services ceases, and we may delete your Customer Data in accordance with our data retention policy.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Noida, Uttar Pradesh, India.

Before initiating legal proceedings, the parties agree to attempt to resolve disputes in good faith through written communication.

12. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with the revised "Last updated" date. Continued use of the Services after changes constitutes acceptance of the revised Terms.
